PLEASE READ THESE TERMS OF USE ('AGREEMENT' OR 'TERMS OF USE') CAREFULLY BEFORE USING THE WEBSITE, MOBILE APPLICATIONS, AND SERVICES OFFERED BY COLLECTIO.BID AND ITS SUBSIDIARIES (COLLECTIVELY, 'COLLECTIO.BID'). THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE WEBSITE AT WWW.COLLECTIO.BID (THE 'SITE'), MOBILE APPLICATIONS, AND SERVICES PROVIDED BY COLLECTIO.BID (COLLECTIVELY, THE “SERVICES”).

By using the Services in any manner, including but not limited to visiting or browsing the Site (“we”, “our” or “us”), you (the 'user' or 'you') agree to be bound by this Agreement, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. This Agreement applies to all users of the Services, including without limitation users who are vendors, customers, and merchants, contributors of content, information and other materials or services on the Site.

1. Objectives and Responsibilities

Collectio.bid acts as a venue offering services to owners of various objects and collectors of all kinds to come into contact through this website and conduct sales and purchases of objects, items and services of collectible, historical or artistic interest.

Collectio.bid is not a commercial store.

The items for sale are offered by the sellers themselves (either by private collectors or professional merchants) through direct sale, or through auction to the highest bidder via our website applications.

Collectio.bid is not directly involved in the transaction between buyers and sellers. As a result, the site has no control over the quality, legality of possession and ownership of an item, the safety of the transaction, nor can it ensure the ability of sellers to sell items or the ability of buyers to pay for items purchased. Collectio.bid cannot ensure that a buyer or seller will actually complete a transaction and cannot transfer the title of ownership of these items from the seller to the buyer.

Collectio.bid can have an opinion on issues of genuineness and authenticity of the offered items and to comment in an advisory capacity regarding incorrect description, forgeries, collector-inspired creations or as suspect and requiring in-person examination and/or the opinion of an expert. The company can recommend to potential buyers the names of experts capable of examining such items. Collectio.bid cannot be held accountable in any way for our comments regarding items we consider problematic.

Under these terms and conditions of use, you agree that Collectio.bid is a venue and as such is not responsible or liable for any content, i.e. data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on the Site, including issues of intellectual property rights that may result from such postings.

You use the Collectio.bid services at your own risk.

The evaluation we recommend users complete regarding each of their transactions with each other is a very good indication of the quality of each user and of the “safety” that accompanies each of his or her transactions. Even though Collectio.bid will monitor the evaluations of its members, the use of this service is the member’s responsibility and we are not liable for any negative or adverse outcomes resulting from this feedback/evaluation process.

2. Membership Eligibility

Age: Our services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. You represent and warrant that you are at least 18 years old and that all registration information you submit is accurate and truthful. Collectio.bid may, in its sole discretion, refuse to offer access to or use of the Services to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Services is revoked in such jurisdictions.

Individuals under the age of 18 must at all times use our services only in conjunction with and under the supervision of a parent or legal guardian who is at least 18 years of age. In all cases, the adult is the user and is responsible for any and all activities.

The member user declares and guarantees that the information provided during registration is true and accurate, necessarily including the full name of the member, the address with the correct postal code of the main residence, a cellular phone (recommended), and a valid email address. In the case of a company or professional merchant registering as a user, the true and correct name of the person responsible for the company’s communication must be given, the full name of the company, the tax identification number of said business, as well as the name of the revenue service district in which the company belongs (if it is a Greek company) and the country. In case of any changes, the member has a duty to keep all Account information up to date and true. The website counts on each member’s declaration of personal information and in no way does it bear any responsibility for given data. The member gives his or her expressed consent to the collection and processing of such given data as per the present Terms and as per the practice of Personal Data Protection by our website. The member has the ability to withdraw his or her consent at any point in time for further collection and processing by deleting his or her membership as per the relevant text in the following sections of the Terms of Usage.

Collectio.bid cannot guarantee the true identity, age, and nationality of a user. We encourage you to communicate directly with potential transaction partners through the tools available on the Site. You may also wish to consider using a third-party escrow service or services that provide additional user verification.

In the first phase of the website’s operations, registration to become a member is free and all members can enjoy all of the services offered by the website. From the beginning of 2017, the services regarding the genuineness and certification of items will be offered only to the privileged members who will pay an annual subscription.

Compliance with current legislation: The members alone bear the responsibility to comply with the current legislation of Greek law and Greek taxation legislation and the Code of Books and Data, or the legislation of their respective country of residence. In any case, collection.bid does not bear any responsibility for its members’ abiding to their respective tax legislation. However, Collectio.bid is obligated to conform to a request by the appropriate authorities to provide any information requested legally regarding member transactions through its venue without previously notifying or requesting consent by the members as explicitly stated in article 82, paragraph 2 of the ΚΦΕ (v.2238/1994 ΦΕΚ: A 151 19940916).

Furthermore, members must agree with the following policies of the website, as well as the rules of usage and procedures that may be announced and updated in the website, without previous notification to you.

In addition, some services offered by us may be subject to additional terms and conditions promulgated by Collectio.bid from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into this Agreement by this reference.

User name: The “user name” selected by each member cannot be illegal; i.e. lewd, demeaning or inappropriate in any way or in violation of the private intellectual or other such rights of others. Furthermore, the user name cannot include email address or internet website indications, information of personal contact with the user, to cause harm to the rights of others, and it is forbidden to write the clear full name of persons.

Password: Keep your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify us of any unauthorized use of your password or any breach of security. You also agree that we cannot and will not be liable for any loss or damage arising from your failure to keep your password secure. You agree not to provide your username and password information in combination to any other party other than us without our express written permission.

Account Information: You must keep your account information up-to-date and accurate at all times, including a valid email address. To sell items on Collectio.bid you must provide and maintain valid payment information such as valid credit card information or a valid PayPal account.

Account Transfer: Each account and user names are personal and unique. You may not transfer or sell your Collectio.bid account and User ID to another party. You are responsible for all activity of the account and User ID. If you are registering as a business entity, you personally guarantee that you have the authority to bind the entity to this Agreement.

Right to Refuse Service: Collecti.bid has the right to interrupt temporarily or completely its services to its members. We reserve the right, in our sole discretion, to cancel unconfirmed or inactive accounts. We reserve the right to refuse service to anyone, for any reason, at any time.

3. Fees and Billing

Joining and setting up a shop on www.collectio.bid is free. Collectio.bid charges an insertion fee for listing an item for direct sale or through an auction, whereas there are no additional charges for images (photos or scans, etc.). No matter the type of sale, collectio.bid charges as well as a percentage of the sale price when the item sells. When you list an item you have an opportunity to review and accept the fees that you will be charged. Collectio.bid’s Fees Policy, which is subject to change, is incorporated into this Agreement by reference. Changes to the Fees

In certain situations, including but not limited to a void or invalid transaction, the site may issue a credit for the applicable fees to a seller's billing statement provided the seller is not responsible for voiding or invalidating the transaction in question.

Payment of fees and charges : You are responsible for paying all fees, charges and applicable taxes associated with using Collectio.bid. We will send an invoice to the seller’s email address on file detailing the amount due for the prior month’s fees and charges. The seller pays automatically the amount due in full within 15 days of the date of the invoice. The payment is made through the balance of the account on the website. If the balance is not adequate, the member must immediately replenish his or her account balance, otherwise payment is considered past due. A past due invoice may cause the items offered for sale by the member to be temporarily invisible to the rest of the membership, until payment in full has been received.

Credit Limit: With the term “credit limit” we refer to the maximum amount owed by a member to collectio.bid before the member’s account is blocked. The particular term does not imply the meaning of providing services for future payment. Collectio.bid retains the right to whenever and without cause to change or even terminate on its free will the credit limit, without the company being subject to previous member notification.

Fees and Termination: If collectio.bid terminates a listing or your account, if you close your account, or if the payment of your collectio.bid fees cannot be completed for any reason, you remain obligated to pay collectio.bid for all unpaid fees plus any penalties, if applicable. If the seller's account is not paid in full and becomes past due, the seller risks penalties such as the suspension of privileges and/or termination of the account and other collection mechanisms (including retaining collection agencies and legal counsel).

4. Listing and Selling

Listing Description: All listings on collectio.bid must be for sale directly or through an auction format. By listing an item on the Site you warrant that you and all aspects of the item comply with our published policies. You also warrant that you may legally sell the item. This is binding for the seller and such a warrant is accepted (implicitly or explicitly) by the buyer during the arrangement of the electronic contractual nature of the transaction.

Specifically, all listings are made with the exclusive responsibility of the seller, who is responsible for the content of the listings: a. the accurate and succinct description of your items, b. all material and description regarding the item (such as illustrations, images, description regarding the item, forwarded messages, occasional links to other websites- bibliography, etc. c. and all terms of sale (i.e. time frame of delivery, cost of shipping, fees, means of accepted payment, etc.). Collectio.bid does not adopt, accept or is responsible for the seller’s offers. If deemed necessary, collectio.bi reserve the right to request that a seller modifies terms of sale or policies.

Description and Image(s) of the Item(s): Both the description and the images of the item(s) are part of the listing, in other words, the seller ensures that the item possesses the qualities described and illustrated. The illustrations/images (photographic or scanned) must be of high definition and possible faults cannot be concealed.

Binding Sale: The seller is obligated to ship the order, provide the service, or otherwise complete the transaction with the buyer. In case that one member (from 2017 only privileged members will have the ability to do so) requests the intervention of collectio.bid for the issuance of a Certificate of Authenticity from a recognized expert necessarily collaborating with collectio.bid, the sale of the item remains unsettled. The expenses of the certification process may be born either by the seller or the buyer, after their own agreement, whereas the fees for the issuance of a certificate are set by the expert. In every case, and regardless of the outcome of the certification process, the seller is obligated to pay collectio.bid the charges associated with the sale of the item, even if such sale is in the end voided.

Fee Avoidance: The price stated in each item listing description must be an accurate representation of the sale. Sellers may charge reasonable shipping and handling fees to cover the costs for packaging and mailing the items. Sellers may not charge a low sale price while charging excessive shipping and handling fees for the purpose of avoiding paying appropriate collectio.bid commission fees.

5. Ways of Offering Products on collectio.bid

The following are the ways of offering items for sale:

a. Offers with a fixed price for immediate purchase (Buy Now). The listing of an item with pre-determined time duration, with a fixed price set by the seller, binding towards its immediate availability to anyone willing to purchase the item immediately and to pay the fixed price (in addition to any shipping and handling fees).

b. Auction-style sale with a starting bid (Auction). The listing of an item offered via an auction, with a start price, and pre-determined time duration set by the seller; this type of sale is binding and the item is available to the highest bidder, as per the bidding offers made by the end of the item’s duration. Bidding increments are as such:

€0.01-€0.99: €0.05

€1.00-€4.99: €0.25

€5.00-€24.99: €0.50

€25.00-€99.99: €1.00

€100.00-€249.99: €2.50

€250.00-€499.99: €5.00

€500.00-€999.99: €10.00

The price is determined by the offers made and binds the bidding buyer to pay according to the terms and conditions set by the seller.

6. Prohibited, Questionable and Infringing Items and Activities

The sale of or insertion for sale of the following is strictly forbidden:

a. Stolen objects or objects of which the legal possession cannot be confirmed.

b. Not authentic, forged or illegal objects, or items that may be subject to legislation regarding archaeological objects.

c. Objects that infringe upon any third-party's copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy.

Illegal exportation

If there are objects of which the exportation to other countries is forbidden, this must be explicitly stated in their description.

The insertion for sale of items listed below is forbidden:

a. Texts and images that infringe upon any third-party's copyright, patent, trademark, trade secret

or other proprietary or intellectual property rights or rights of publicity or privacy.

b. Texts or images that are obscene or contain child pornography

c. Content thought to be defamatory, or is in violation of any applicable law, decree, regulation or such legal form.

d. Content in violation of legislation regarding unlawful competition, eradication of unequal treatment, or misleading advertisement.

Modern Replicas or Reproductions/Re-printings

Even if such objects may not be collectibles in and of themselves (i.e. maps, sketches, books, posters, postcards), the information provided or their image may be cause for their sale/purchase. You must describe these explicitly as replicas within the description of the items.

Philatelic Objects

Due to their peculiarity, and because philatelists collect and study/research everything, items that are not authentic are allowed to be sold, only if the seller clearly states so in the description. In case an opinion request or denunciation of an item from a privileged member, collectio.bid examines the particular case and is bound to complete and post its comments that will be uploaded by the collectio.bid administrator (from 2017 these comments will only be viewable by privileged members).

Such items can be labelled as forgeries, faulty, altered, repaired, private creations, object of philatelic “inspiration,” etc.

For any such insertions by the administrator alone or in collaboration with experts, no type of action can be brought forth against collectio.bid by the seller for possible moral or monetary injury.

7. Content

The user must take care so that the texts, the links and the images publicized in the collectio.bid website in any shape or way (offers, evaluations, insertions in the “question and answer” frame, etc.) either appear in the collectio.bid website for other reasons, must be in agreement with the following rules concerning:

a. Intellectual property rights of third persons. Members can use and publicize images and texts within the collectio.bid website that they themselves have created or that the rightful owner has agreed to. That also applies to texts and images publicized in other websites. In any case, the member himself bears full responsibility for the content of his offers and not collectio.bid. It is duly noted that in some cases, without this being absolute, the full bibliographical reference of a text or an image is a sufficient reason for their insertion.

b. Not demeaning to the personality of third persons. Members cannot insult others such as their personality, the price, the reputation, personal information, etc. nor can they include anything lewd, libellous, harassing, demeaning in their content regarding one’s honor, etc.

c. No advertising: No advertising of any type can be included for products that the member does not offer already on our website.

d. Links and website addresses: It is not allowed to include URL links or website addresses with commercial activities.

e. No contractual arrangement outside of collectio.bid . It is not allowed that members intend on arriving at a contractual agreement with each other directly or indirectly outside of collectio.bid.

f. Truthful usage of the member evaluation mechanism (feedbacks): Members have the responsibility to give truthful evaluations to the members with whom he deals. Evaluations must be objective and cannot include personal insults. It is not allowed to incorporate any advertisements within an evaluation (i.e. the insertion of a URL link). No unwanted interpolation in the personal or another’s feedback profile (i.e. through the use of different user names) is allowed. For reasons of personal data protection, references to actual members’ data in an evaluation are not allowed. Also, the submission of deceitful evaluations and/or the manipulation of the feedback mechanism for personal gain are not allowed. Collectio.bid has the right at any time, and without prior notification, to intervene in the otherwise independent feedback mechanism and either delete and/or change evaluations if it is brought to our attention that some of them may be illegal, demeaning or in breach of formality.

g. No publicizing of a telephone number or email address: It is forbidden to publicize/make known telephone numbers and/or email addresses prior to the conclusion of a transaction in the field of the website or any type of personal information of which the possible revelation aims toward the advertising projection of the member or the drawing of a contractual agreement outside of collectio.bid, or the immediate contact and communication of members outside of the collectio.bid venue.

h. Information Control: The website does not examine the information content provided by the members in their insertions. Doing so may be considered demeaning, injurious, inaccurate, or deceitful. There may be possible dangers when underage persons partake in the process or when certain people act with false pretences. Furthermore, there may be dangers resulting from international trade practices and foreigners’ actions. With the use of this website, the member accepts the possibility of such dangers and that collectio.bid and/or its collaborators are not responsible for any action or omission committed by collection.bid users. The members of colletio.bid should safeguard themselves and use common logic and safety practices for buying and selling online.

i. Other sources: Collectio.bid is not responsible for the availability or functionality of outside websites or sources linked to, or referenced by its site. Collectio.bid does not countersign and does not bear responsibility for any content, advertisement, product or anything that may be preent or offered by those website or sources. Our users accept and agree that collectio.bid is not responsible, directly or indirectly, for any injury or harm caused by or supposedly caused by or in conjunction with the use or trust placed in the content, goods or services that are available by or through anyone associated with such websites or sources.

j. Retaining of Data on collectio.bid and online . All data insertions regarding our members and the products for sale remain available to collectio.bid. It is also possible that for technical reasons some of the personal information data be available to possible third grantors of service with whom collectio.bid has no relationship nor are under our control (i.e. internet search engines, social media sites, etc.)

8. Buyer – Seller Relations

Collectio.bid cannot guarantee that the members of the website during their commercial transactions will behave in a legal or/and based on the good faith principle. Collectio.bid in particular, cannot participate and cannot guarantee in any case the correct and proper execution of the transaction responsibilities by the two parties. At any rate, collectio.bid becomes aware from the feedback mechanism of any possible misdoings and denouncements and acts accordingly.

a. Binding Offer: If the sale of an item has not been completed or there has been no bid offer at auction, the seller has the right to delete his offer for sale and to withdraw his insertion even before the end of the time frame for fixed price or auction items.

b. Type of purchase . The purchase is valid only if it is registered in the required page of the product insertion. Offers made in any other form, particularly in an email, through personal means of communication (sms, msn, etc.) are not accepted as valid and not taken into consideration.

c. Binding character of the purchase . With the purchase, the buyer agrees to the sale of the product according to the terms set by the seller. In case that after the electronic contractual agreement of the transaction the two parties wish to agree on specific terms with each other directly (means of payment, shipping type and costs, etc.) this is only possible after they both agree in writing (with electronic messages via our website), otherwise the original electronic contractual agreement terms remain valid. The one who makes the purchase is bound to the original terms. No unilateral revocation of the sale is possible.

d. Contractual Agreement: At the end of an auction, a binding electronic contract is made between the seller and the bidder/buyer that is governed by the Civil Code, as well as the various arrangements valid for the contractual agreements from afar and electronic commerce when they are applied. The participating bidder/buyer and the seller are solely responsible for keeping their agreement and observing all the appropriate decrees and laws. Collectio.bid bears no responsibility whatsoever and does not partake or participate in any way in a selling-buying contract.

e. Content of Contract :

i. Seller’s terms

The content of the contract is determined by the product description as written by the seller (including possible future mutually acceptable changes such as seller’s information in the frame of “questions to the seller”) the images (reproduction of photographs and/or scans) as well as the terms set by the seller, as they appear at the time of the successful purchase on the webpage of the offer,, and also from the possible agreements between the transacting parties. The seller has the obligation to transfer to the buyer, in lieu of payment, the legal and actual possession of the product. It’s not allowed to have a relative denial of responsibility on the part of the seller. Explicitly, the seller cannot transfer to the buyer the seller’s responsibility to pay the collectio.bid fees for the transaction. The sale’s price must include the appropriate VAT, if it applies.

ii. Description and illustration of the product

Both the description and the images of the product are part of the contract, in other words, the seller ensures that the product has the qualities as described and illustrated based on the particular decrees of the present General terms and legal foresight. The images must be of high resolution and no possible faults can be concealed. If some elements are not apparent or do not match, then the seller must describe so in a clear manner.

iii. Content deficient of different seller’s terms in the purchases of products:

If during the purchase there are no different terms and/or there is not a clearly different product description by the seller, and the participating parties have not mutually agreed something else between them, then in the purchases of goods the following are valid:

The seller is responsible for the true faults, in other words, those not described, which decrease the value or have a negative impact on the usability of the object. In particular, the seller is responsible, in the case of missing clear description, for the authenticity or genuineness of the sold product. The danger of loss of the product during its transfer/dispatch to the buyer burdens the seller. All the appropriate decrees regarding a sales transaction of the Civil Code are valid as are the particular legislative regulations regarding contractual agreements from afar and electronic commerce (where applicable).

f. Execution of contract

i. General

Both participating parties are obliged to fulfil completely, properly, and in a timely fashion their responsibilities as per the selling contract. It is self-evident that this obligation is retained even in the situation whereby for whatever reason the services of collectio.bid are either interrupted or terminated. The execution of the contractual terms is a matter between the two contractual parties. The completion (execution) of the contract is determined by the then current contractual terms.

If the offer does not include more specific rules and the two contractual parties have not agreed to something else, then the following apply (ii-iv):

ii. Payment for the purchase:

Purchases are pre-paid.

iii. Communication:

Each contractual party must give to the other party within 7 (seven) calendar days from the contractual agreement all the information needed so that the contract can be fulfilled. This is mainly about shipping costs and banking information (in case the means of payment is designated as a money transfer to a bank account and this information was not already available in the original listing) from the seller’s side and the postal address from the buyer’s side. If one of the contractual parties does not have the information of the other party that are necessary for the fulfilment of the contract, then that party is obligated within 7 days from the agreement to request such information at least twice via email. If the information is not given to that party, then after the 7 calendar day limit, the party is able to exercise his rights as prescribed by the Civil Code.

iv. Past Due

The sum due of the contract must be completely and properly paid within 14 calendar days from the date of the contractual agreement.

v. Defective Product:

If some product shows a defect or fault that is not mentioned in the description of the product or is not visible in the images and which decreases significantly or eliminates the value or appropriate use of the product, then the buyer must inform within 14 calendar days from its receipt the seller in order to request a replacement, with the seller’s expense, or the return of the monies paid for the product. The same applies when an item does not possess a particular trait that is mentioned in its description. If the seller takes no action after having been informed twice of the defect or if its replacement is not to the satisfaction of the buyer, then the buyer can exercise his rights given to him by the Civil Code and the applicable legislation regarding sales.

9. Responsibility Exclusion of collectio.bid

a. General: Collectio.bid reserves the right to whenever, without a cause and with indemnity to interrupt or terminate its services and/or its function either infinitely or temporarily without having the obligation to offer prior notification to its members. Collectio.bid is only responsible for immediate injuries, caused by deceit or gross negligence on the part of collectio.bid.

b. Technical Problems, Maintenance: Collectio.bid does not bear any responsibility for the temporary unavailability of the website, the interruption of some or all functions or for its possible malfunction. In particular, collectio.bid is not responsible for technical problems due to which sales/purchases were made incorrectly or with a time delay. Collectio.bid bears no responsibility for the correct timing of the system with the time of the website with the time that may have been established officially. The website may be temporarily unavailable partially or in whole due to maintenance work or for other reasons, without any user or member be able to make demands against collectio.bid.

c. Content and offers ; Collectio.bid is not obligated to examine the offers, the evaluations or any information put forth by the members. The site bears no responsibility for:

-the true, correct and legal formation of the offers

-the quality, safety, legality or availability of the offered products

-the ability, authority, and willingness of each member regarding the offer, the purchase, the delivery, payment and all actions regarding the fulfilment of the contract

-for anything else stated explicitly in these General Terms

d. Linked webpages/sites: Collectio.bid cannot guarantee for the information, the correctness, the legality, the completeness or the quality of the content of linked webpages (links) which are accessible via the collectio.bid website, which explicitly denies any relevant responsibility.

10. Applicable Law and Jurisdiction

All disputes between collectio.bid and a member (active or previous) regarding the General Terms are subject to Greek legislation. The jurisdiction lies with the Courts of Athens.
